Process of Property Registration
The property (Land/house) transaction of Nepal is based on Deed System. The government does not guarantee the land property of the people. The government is only the witness, under the deeds system during the transaction of land or building. Following are working procedure and documents needed for different process:
- Deed Registration (Likahat) Process
- Submit an application form in LRO with following minimum supporting documents:
- Existing Land Ownership Certificate,
- Land Tax Receipt for last fiscal year/current month from VDC/municipality,
- Recommendation letter about Building and Road access from local bodies,
- Copy of Citizenship certificate of both buyer and seller,
- Recommendation letter from Guthi (trust) office if the land is under Guthi,
- Two copies of photographs.
- LRO verifies all documents, Signature and thumb impression with the official record, called “Moth Shresta”,
- Send the request to the Survey Office for parcel splitting if required,
- Calculate of Revenue and Capital Gain Tax(CGT) if more than 30 lakhs,
- Calculate discount, if any applicable,
- Deposit of deed registration fee, CGT (if applicable) by Applicant,
- Registration section attach receipt with the application,
- Verify and approve the deed registration by an authorized land officer,
Moth section updates the record and issues a printed land ownership certificate or hand written land owner certificate, where DLIS is not implemented to the landowner,
- Send the Record (Misil) in Archival Section (Tameli) for record reference.
- Process of Namsari:
- Submit an application form in an LRO with following minimum supporting documents:
- Land ownership certificate of dead person,
- Land revenue clearance receipt,
- Copy of Citizenship certificate,
- Birth certificate and parent’s citizenship certificate in case of a child.
- Relationship certificate with dead person by local bodies,
- Death certificate,
- Migration certificate if migrated,
(In the case of the missing person and second marriage (for women only) recommendation should be submitted.)
- LRO verifies all documents, Signature and thumb impression with the official record, called “Moth Shresta”,
- Calculation of fee if applicable. If Namsari after 35 days of the death, the certain fee (fine) is applicable,
- Verify and approve the Namsari by an authorized land officer,
- File sent to Moth section for ownership record update,
- Moth section updates the old record and issues a new printed land ownership certificate or hand written land owner certificate, where DLIS is not implemented to the new landowner,
- Send the Record (Misil) in Archival Section (Tameli) for record reference.
- Dakhil Khariz (Da.Kha.) Process
- Submit an application form in an LRO with following minimum supporting documents:
- Land revenue clearance receipt,
- Copy of Citizenship certificate,
- Birth certificate and parent’s citizen ship certificatein case of child.
- Related documents to Dakhil Khariz – decision of court, auction, and the decision of other government agencies,
- Related other files,
- LRO verifies all documents, Signature and thumb impression with the official record, called “Moth Shresta”,
- Verify and approve the Da. Kha. by an authorized land officer,
- File sent to Moth section for ownership record update,
- Moth section updates the old record and issues a new printed land ownership certificate or hand written land owner certificate, where DLIS is not implemented to the new land owner,
- Send the Record (Misil) in Archival Section (Tameli) for record reference.
- Process of Land Registration (Jagga Darta)
- Submit an application form in an LRO with following minimum supporting documents:
- Previous land ownership Record with local body,
- Land revenue clearance receipt,
- Copy of Citizenship certificate,
- Field book copy,
- Recommendation of local bodies or municipality,
- If the transformation of ownership, death certificate(If required),
- If Dakhil khareej, Concerning Likhat with other documents,
- In the case of birta, jhoora, ukhada and kipat the applicant should show their proof of land how they got the land.
- LRO verifies all documents, Signature and thumb impression with the official record, called “Moth Shresta”,
- Approval process by committee (decision),
- Payment of service charges,
- File sent to Moth section for ownership record update,
- Moth section updates the old record and issues a new printed land ownership certificate or hand written land owner certificate, where DLIS is not implemented to the new land owner,
- Send the Record (Misil) in Archival Section (Tameli) for record reference.
- Process of Amendment
- Submission of the application form,
- Application,
- Citizenship certificate, birth certificate, certificate of relationship to dead person,
- Marriage certificate,
- Recommendation of local bodies,
- Revenue receipt,
- Tax receipt,
- Court decision,
- Deed registration,
- Survey map,
- Verification of documents,
- Splitting of land parcel, if required,
- Public notice (35 days),
- Decision taken by LRO,
- Deposit of fee,
- Record update in moth,
- Verification by an authorized land officer,
- Amendment (correction/modification) in certificate,
- Record in archival.
